Please read this arbitration and class action waiver provision carefully. It requires you to arbitrate disputes with Bearaby and limits the manner in which you can seek relief from us.
Except where prohibited by law, you agree that any claim that you may have in the future must be resolved through final and binding confidential arbitration. You acknowledge and agree that you are waiving the right to a trial by jury. The rights that you would have if you went to court, such as discovery or the right to appeal, may be more limited or may not exist. You agree that you may only bring a claim in your individual capacity and not as a plaintiff (lead or otherwise) or class member in any purported class or representative proceeding. You further agree that the arbitrator may not consolidate proceedings or claims or otherwise preside over any form of a representative or class proceeding.
There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages), and must follow the terms of these Conditions of Use as a court would.
GeneralArbitration is a manner of resolving a “Claim” without filing a lawsuit. “Claim” means any dispute between you, Bearaby, or any involved third-party relating to your account, your use of the Website, your relationship with Bearaby, these Terms, or the Privacy Policy. This includes any and all claims that relate in any way to your use or attempted use of the products, and any act or omission by Bearaby or any third-party related to your use or attempted use of the products. You, Bearaby, or any involved third-party may pursue a Claim. Bearaby agrees to final and binding confidential arbitration should it have any Claims against you. Likewise, you agree to final and binding confidential arbitration should you have any Claims against Bearaby. By agreeing to arbitrate, you waive the right to go to court and agree instead to submit any Claims to final and binding confidential arbitration. You further agree that all claims must be arbitrated on an individual basis and not on a class basis, only individual relief is available, and that claims of more than one customer cannot be arbitrated or consolidated with those of any other customer. This arbitration provision sets forth the terms and conditions of our agreement to final and binding confidential arbitration and is governed by and enforceable under the Federal Arbitration Act (the “FAA”), 9 U.S.C. §§ 1–16, as amended.
Notwithstanding anything to the contrary herein, (a) a representative action for public injunctive relief pursuant to California’s Consumer Legal Remedies Act (Cal. Civ. Code § 1750 et seq.), Unfair Competition Law (Cal. Bus. & Prof. Code § 17200 et seq.) and/or False Advertising Law (Cal. Bus. & Prof. Code § 17500 et seq.) must be arbitrated on a class basis, (b) in the event that the foregoing clause is deemed invalid or unenforceable, a representative action for public injunctive relief pursuant to California’s Consumer Legal Remedies Act (Cal. Civ. Code § 1750 et seq.), Unfair Competition Law (Cal. Bus. & Prof. Code § 17200 et seq.) and/or False Advertising Law (Cal. Bus. & Prof. Code § 17500 et seq.) may be brought in the state or federal courts located in Manhattan, New York on a class basis, and (c) any claims other than for public injunctive relief must be arbitrated on an individual, non-class basis as otherwise set forth in this Section.
ExceptionsNotwithstanding the foregoing, and as an exception to final and binding confidential arbitration, you and Bearaby both retain the right to pursue, in small claims court, any claim that is within that court’s jurisdiction and proceeds on an individual (non-class) basis, including overdue account matters within the small claims court’s jurisdiction. Bearaby will not demand arbitration in connection with any individual claim that you properly file and pursue in a small claims court, so long as the claim is and remains pending in that court. The following claims shall not be subject to final and binding arbitration and must be adjudicated only in the state or federal courts located in Manhattan, New York: (i) an action by Bearaby relating to the infringement or validity of our proprietary rights, including without limitation, trademarks, service marks, trade dress, copyrights, trade secrets, or patents; or (ii) an action by Bearaby for temporary, preliminary, or permanent injunctive relief, whether prohibitive or mandatory, or other provisional relief, against you for breach or threatened breach of this Agreement. You expressly agree to refrain from bringing or joining any claims that are excluded from final and binding arbitration pursuant to this subsection “b” in any representative or class-wide capacity, including but not limited to bringing or joining any claims in any class action or any class-wide arbitration. Small claims matters may be filed in any small claims court with personal and subject matter jurisdiction over the parties. For all other matters excluded from final and binding arbitration by this subsection “b,” the parties consent to exclusive jurisdiction and venue in the state and federal courts located in Manhattan, New York, and forever waive any challenge to said courts’ jurisdiction and venue.
Required pre-dispute proceduresWe acknowledge and agree that before initiating any Claim against the other, we agree to first contact the other with a written description of the dispute, which shall include all relevant documents and information, and the proposed resolution. You may send the written description of any dispute you have with us by U.S. Mail to Bearaby, Attn: Legal Department, 382 NE 191st Street, Suite 98910, Miami, Florida, 33179. Bearaby will contact you by letter at the billing address you provided to us or at the email address you provided to us. You agree to negotiate with Bearaby or its designated representative in good faith about your problem or dispute. If for some reason the dispute is not resolved within 60 days after receipt of the written dispute, we agree to the dispute resolution provisions below. Notwithstanding the foregoing or any other term of this arbitration agreement, we will have the right to seek injunctive or other equitable relief in state or federal court located in Manhattan, New York to enforce these Terms or prevent an infringement of a third party’s rights or our intellectual property rights, as stated in subsection “b” above. You hereby expressly consent to, and forever waive any challenge to, the exclusive personal jurisdiction and venue of said courts in such actions.
Commencing arbitrationAny unresolved dispute or controversy arising from or relating to these Terms shall be finally resolved by binding arbitration through the platform provided by New Era ADR, Inc. (https://app.neweraadr.com/) (the “New Era Platform”) in accordance with its rules and procedures for “Virtual Expedited Arbitrations” by a professional neutral(s) with substantial experience in resolving commercial disputes (the “Neutral”). The Neutral shall be chosen in accordance with the rules and procedures of the New Era Platform. The parties will bear costs as provided for under this Agreement or, if silent, in accordance with the rules and procedures of the New Era Platform. The prevailing party may be entitled to receive reimbursement of its reasonable expenses (including reasonable attorneys’ fees and all other expenses) incurred in connection therewith, at the Neutral’s discretion.
A party shall initiate an arbitration through New Era ADR at https://app.neweraadr.com. The contact information for Bearaby shall be help@bearaby.com and for the customer it shall be the last known email address. EnforceabilityThis provision survives termination of your account or relationship with Bearaby, bankruptcy, assignment, or transfer. If the class action waiver is deemed unenforceable (i.e., unenforceability would allow arbitration to proceed as a class or representative action), then this entire arbitration provision shall be rendered null and void and shall not apply. If a portion of this arbitration provision (other than the class action waiver) is deemed unenforceable, the remaining portions of this arbitration provision shall remain in full force and effect.
MiscellaneousFailure or any delay in enforcing this arbitration provision in connection with any particular Claim will not constitute a waiver of any rights to require arbitration at a later time or in connection with any other Claims except all Claims must be brought within the 1 year limitation period set forth above. This provision is the entire arbitration agreement between you and Bearaby and shall not be modified except in writing by Bearaby.
AmendmentsBearaby reserves the right to amend this arbitration provision at any time. Your continued use of the Website, purchase of a product on or through the Website, or use or attempted use of a Bearaby product, is affirmation of your consent to such changes. Should the changes to this arbitration provision be material, Bearaby will provide you notice and an opportunity to opt-out. Your continued use of the Website, purchase of a product on or through the Website, or use or attempted use of a Bearaby product or service, is affirmation of your consent to such material changes.
You understand and agree to have any claims decided individually and only through binding, final, and confidential arbitration. You have the right to opt-out of this arbitration provision within thirty (30) days from the date that you purchase, use, or attempt to use a product purchased on or through the Website (whichever comes first) by writing to us at Bearaby, Attn: Legal Department, 382 NE 191st Street, Suite 98910, Miami, Florida. For your opt-out to be effective, you must submit a signed written notice identifying any product you purchased, used, or attempt to use within the 30 days and the date you first purchased, used, or attempted to use the product. If more than thirty (30) days have passed, you are not eligible to opt out of this provision and you must pursue your claim through binding arbitration as set forth in this Agreement. Should either party file an action contrary to this provision, the other party may recover attorney’s fees and costs up to $1000.00.
In the event that there is a dispute, claim, or controversy between you and us, or between you and Stodge Inc. d/b/a Postscript or any other third-party service provider acting on our behalf to transmit the mobile messages within the scope of the Program, arising out of or relating to federal or state statutory claims, common law claims, this Agreement, or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, such dispute, claim, or controversy will be, to the fullest extent permitted by law, determined by arbitration in Agoura Hills, CA before one arbitrator. No class actions. You understand and agree that, by agreeing to this Agreement, you and Bearaby are each waiving the right to a trial by jury or to participate in a class action and that this Agreement shall be subject to and governed by the Federal Arbitration Act (the “FAA”). The parties agree to submit the dispute to binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association (“AAA”) then in effect. Except as otherwise provided herein, the arbitrator shall apply the substantive laws of the Federal Judicial Circuit in which Bearaby’s principal place of business is located, without regard to its conflict of laws rules. Within ten (10) calendar days after the arbitration demand is served upon a party, the parties must jointly select an arbitrator with at least five years’ experience in that capacity and who has knowledge of and experience with the subject matter of the dispute. If the parties do not agree on an arbitrator within ten (10) calendar days, a party may petition the AAA to appoint an arbitrator, who must satisfy the same experience requirement. In the event of a dispute, the arbitrator shall decide the enforceability and interpretation of this arbitration agreement in accordance with the FAA. The parties also agree that the AAA’s rules governing Emergency Measures of Protection shall apply in lieu of seeking emergency injunctive relief from a court. The decision of the arbitrator shall be final and binding, and no party shall have rights of appeal except for those provided in section 10 of the FAA. Each party shall bear its share of the fees paid for the arbitrator and the administration of the arbitration; however, the arbitrator shall have the power to order one party to pay all or any portion of such fees as part of a well-reasoned decision. The parties agree that the arbitrator shall have the authority to award attorneys’ fees only to the extent expressly authorized by statute or contract. The arbitrator shall have no authority to award punitive damages and each party hereby waives any right to seek or recover punitive damages with respect to any dispute resolved by arbitration. The parties agree to arbitrate solely on an individual basis, and this agreement does not permit class arbitration or any claims brought as a plaintiff or class member in any class or representative arbitration proceeding. Except as may be required by law, neither a party nor the arbitrator may disclose the existence, content, or results of any arbitration without the prior written consent of both parties, unless to protect or pursue a legal right. Notwithstanding anything to the contrary in this Agreement, if Bearaby makes any future change to this arbitration provision, you may reject the change by sending us written notice within 30 days of the change to 90 Church Street, NY 10008, New York, in which case this arbitration provision, as in effect immediately prior to the changes you rejected, will continue to govern any disputes between you and Bearaby.
If any term or provision of this Section is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Section or invalidate or render unenforceable such term or provision in any other jurisdiction. If for any reason a dispute proceeds in court rather than in arbitration, the parties hereby waive any right to a jury trial. This arbitration provision shall survive any cancellation or termination of your agreement to participate in any of our Programs.
You agree to indemnify, defend and hold harmless bearabystore and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
We hope that you’ll love your Bearaby weighted blanket, but we want to give you the peace of mind that our Cotton Nappers, Tree Nappers, Nappling, Hugger (queen & king-size weighted blankets), and Travel Nappers have a 1-year warranty.
We guarantee that we will, at Bearaby’s discretion, repair or replace your purchase within 1 year of the order’s delivery date* if the product is defective due to faulty workmanship or materials, subject to the limitations outlined below.
This warranty does not cover damage due to external forces beyond the materials or workmanship, such as: damage resulting from not following care instructions, comfort preference, spills and stains, being cut with scissors or pet claws, accidents, abuse, neglect, normal wear and tear (including pilling), or other external damage not related to the product quality itelf. Furthermore, the 1-year warranty is void once the product leaves the contiguous US.
During the 1-year warranty period, we (Bearaby) will repair or replace your product with the current style, which may be different from the original product, but the same in value. All return shipping costs will be paid by Bearaby, and any third-party shipping expenses will not be reimbursed to the customer.
Should a replacement product be given, no new warranty will be provided for the replacement product once it is shipped. The warranty approval is up to our (Bearaby’s) sole discretion, and not up to the customer’s interpretation of our warranty policy at any point.
Bearaby’s 1-year warranty covers official Bearaby products purchased from Bearaby directly or any of its authorized retailers. Should you wish to submit a warranty claim on a product purchased from one of our authorized retail partners, you must contact the retailer directly with proof of purchase before we can begin investigating the claim.
Please note, our 1-year warranty policy is effective starting June 1, 2025. Orders placed before this date are not eligible for our 1-year warranty.
Exclusions
Please note that “final sale” items are not eligible for our 1-year warranty coverage.

In order to file a claim, you must follow the warranty process outlined below. Our Customer Service Representatives shall assist you and make the final determination regarding your warranty claim.
